VILLAGE OF EVENDALE
BOARD OF ZONING APPEALS
MINUTES FOR THE
FEBRUARY 5, 2014

        A public meeting of the Board of Zoning Appeals (the “BZA”) was called to order by Chairman Al Schutte at 7:30 PM on Tuesday, February 5, 2014, in the Council Chambers of the Village of Evendale Municipal Building.  Attending were Chairman Al Schutte, members Lynn McCarthy and Mike Reed.  Member Dave Harwood was absent.  Supporting the BZA was Pam Morin from the Evendale Building Department.

After all those present who planned on giving testimony were duly sworn in by Chairman Schutte, the following appeal was heard:

        Chuck Melampy, 9693 Otterbein Road
The applicant has submitted an application for a variance from the ten foot side yard setback in the Residential District.

Mr. Melampy presented drawings and pictures of the proposed carport on the north side of his home.  The carport would be built on the existing concrete slab.  This carport would allow him to provide some protection for his truck from the weather and sun.  

Findings of Facts:

After hearing Mr. Melampy’s testimony and reviewing the documents filed and exhibits presented, the BZA makes the following Findings of Fact:

1.      The existing concrete pad is five feet from the north property line and 2.5 feet above the neighbors ’s property;
2.      The overhang of the carport will not exceed the concrete pad;
3.      The variance request is 50% of the required setback;
4.      The neighbor’s house to the north isn’t centered on their property because of an existing ravine.  Their house is located ten feet from Mr. Melampy’s property line;
5.      Mr. Melampy currently has a two car garage;
6.      Most homes in the neighborhood have single car garages and there are only two carports in the area.

The e-mail from the neighbors located north of Mr. Melampy was read into the minutes.  They have no objection to the proposed carport.  

Mike Reed made a motion to deny the variance request based on the following facts:
•       The variance request is 50% of the existing required setback;
•       The proposed carport would be in addition to the existing tow car garage;
•       The addition would not be in character with the neighborhood;
•       There is concern of the impact it would have on the neighborhood;
Lynn McCarthy seconded the motion.  The motion passed with a 3 yes, 0 no vote.

Lynn McCarthy made and Al Schutte seconded the motion to adjourn the meeting.  The motion passed with a vote of 3 yes, 0 no.

The meeting was adjourned at 8:30 PM.
